Solving Problems Presented by Offshore Accounts
There are certainly legitimate reasons for someone to put money into an offshore account. People often use them for tax reasons or to insulate assets from creditors. Once the assets are in these accounts, it can be very difficult for a spouse to access them in divorce.
We work with accountants and private investigators to help us locate hidden assets, including those in offshore accounts. Once the assets search is complete, there are generally two options that we can use to help make sure you are treated fairly.
- Repatriation: Depending on the location of the offshore account, there may be laws that allow us to "repatriate" the assets. This means that the assets can be brought back to the U.S. and divided by a U.S. court. We will thoroughly investigate this option and see if it is available in your situation.
- Offsetting: In many cases, it is not possible to repatriate the assets. To compensate for this, we work aggressively to make sure that you receive a larger share of other property, offsetting what cannot be obtained from the offshore account.
If your spouse transferred assets to an offshore account to deliberately prevent them from being divided in divorce, we may be able to persuade the court to award you a larger share in the asset division process.
